General Terms and Conditions

Valid from 1st June 2023

The present General Terms and Conditions (hereafter: GTC) includes the conditions of the electronic commercial service available on the www.designbyrothaniko.hu website (hereafter: Website). It also includes the rights and obligations of the Supplier and the person who avails the services (hereafter: User).

2. GENERAL INFORMATIONS

2.1 The legal status of this GTC includes all electronic commercial services in the territory of Hungary, which occur through the electronic market place (herafter: Webshop) of the Website.

2.2 By using the Website the User admits that he knows, understands, notes and accepts the always valid GTC.

2.3 The Supplier maintains the right to change the GTC anytime, unilaterally. This fact is accepted by the User. The valid GTC is available continously on the Website and includes the date of entry into force. For the User of the Website the GTC is the guidance, which is valid on the day of the usage.

2.4 The complete Website -texts, picture descriptions, pictures, photos and other content and formal elements appearig on the Website- are copyright protected. The User notes that these content and formal elements are exclusive property of Anikó Róth. Only Anikó Róth is entitled to use these elements. The User notes and accepts that it is prohibited to copy, transfer or electronically store the pictures, signes, visual and formal elements partly or wholly. It is prohibited to disturb the functioning of the Website or change the contents.

2.5 The User notes and accepts that the owner of www.rothaniko.com and www.facebook.com/rothaniko sites is Anikó Róth. Because products from the Website can be found on both sites the GTC is the guidance both of them too.

3. PRODUCTS AVAILABLE IN THE WEBSHOP

3.1 On the www.designbyrothaniko.hu website the artworks of Anikó Róth graphic-illustrator can be bought. All fine art and applied art products manufactured from high standard and high quality raw materials.

3.2 The essencial features and characteristics of the products can be read in the Webshop, on the information page of the concrete product. The information page of the product includes the size, the most important features, the production time and other comments of the Supplier about the product. The picture of the product in the Webshop can be different in not signficant details from the product sent for the User. The not significant differences do not mean the non-contractual delivery of Supplier. Warrant claims and legal consequences because of breach of contract cannot be validated.

3.3 The products on the Website can be bought online or in person in shops. The distributor shops can be found in the „Shop” list of the Website menu.

3.4 The purchase does not need a registration, but the User can register himself in the Webshop before the first purchase. For the registration all datas have to be filled thoroughly. After the registration the system sends to the given electronic address a confirmation email. By clicking on the link in the email the registration can be activated. The datas added in the registration later can be changed. The registrated User of the Webshop can enter the Webshop by giving his username and password. If the User forgets his password and he adds the udername or the registered email address the system sends a verify code. By adding the verify code the User can adds his new pasword.

3.5 It is possible to subscribe to a newsletter on the Website. The Supplier sends a newsletter at least once a month and sends discount coupons in varying time. The discount coupon consists a coupon code, the amount of the discount in percent or in accurate price, and the deadline of the utilisation. If the coupon is used before the deadline on the Website the code has to be written to the „Coupon code” field at the products in the Cart. After typing the coupon code the discount of the coupon can be activated by clicking on the „Activate” field

4. PURCHASE IN THE WEBSHOP

4.1 The different type of products are sorted in groups. These groups are found in the menu line, on the middle/upper side of the Website. The User can choose from: Notebook, Postcard, Bag, Calendar, Kindle, Wallet, Accessory, Mobile, Original painting, Toy, Budapest Collection, Big City Life Collection, Months Collection, Forest Inhabitants Collection. After choosing from the menu line the products of the given category appear. By clicking on the product or „Details”, the details an the photo of the product become visible.

4.2 After putting the product into the cart the User can return to the products of the Webshop menu or choose the starting of the Order of the product in the Cart by clicking on „Cash”. The User can also delete the product from the Cart. On the information page of the product the number of the required pieces (amount) can be set. The User can check the content of the cart in the Chart menu anytime during the purchase.

4.3 By clicking on the Cash it is possible to purchase without a registration, as a registered member, or with a registration. Because of the order and the shipment the User has to fill the User data sheet by giving his availibilities and address. After giving these datas and choosing the Shipment and the Payment mode the product can be ordered. The content of the chart can be changed and deleted until the forwarding of the Order (until clicking on the Order icon)

4.4 When the User order the product he accepts the amount of the Order and the GTC. Without these conditions the Order does not come into existence.

4.5 The Supplier confirms the order through electronic way as soon as possible after the order. The confirmation consists the code number of the order. The User has to refer to this number in any kind of question about the order. If the confirmation does not arrive to the User in 48 hours, the User becomes free from the contract obligations. If the User filled the order with wrong datas and the email address is not correct the User cannot confirm or fulfill the order. The Supplier does not responsible for harms or discomforts if the order is filled incorrectly.

4.6 In the order process the User has to fill and check the compulsory datas and click on the Order icon. The contract between the Parties comes into existence after this process. The contract between the two Parties is concluded electronically, in Hungarian language. It is not a written contract and does not realte to a Code of Conduct. The contract is related to the Act CVIII. of 2001 law on electronic trade and services of information society. The contract is covered by the particular regulations of 45/2014 (II.26.) Ordinance of contracts between consumer. It comply with the Directive 2011/83/EU of the European Parliament and Counsel of the rights of the consumers.

5. PAYMENT CONDITIONS

5.1 The submission of the orders in the Webshop is only possible by electronic way, through internet on the Website. The Supplier does not accept orders by phone, fax, e-mail or letter.

5.2 After the ordered pruducts are sent to the customer the datas of the orders are stored for 30 days. These datas are necessary if the User has complaints. After the 30 days the Supplier deletes the orders, and the related personal datas from the database regarded to the Privacy Policy.

5.3 The price of the products on the Website are brutto prices, stated in hungarian forint. It includes the always valid Value Added Tax (hereafter: VAT). The price of the products does not contain the delivery cost. The delivery cost does not contain the cost of wrapping.

5.4 The payment of the product(s) is possible by bank transfer to the bank account of the Supplier (Róth Anikó). Datas of the bank acount: Raffaisen  Bank, 12010532-00612526-0010000. In case of personal takeover the price is paid in cash. The way of payment has to be choosed on the „Cash” site by choosing „Way of payment” menu point.

5.5 When the Buyer transfer the price of the product it is compulsory to add the order number in the statement row.

5.6 If the User choosed the transfer option in the order and the price of the ordered products is not payed in 5 days (to the bank account of the Supplier) the Supplier is free from the obligations of the offer and not liable to fulfill the order.

5.7 The Supplier sends the bill with the ordered product to the User. The bill includes the price and the delivery fee of the product.

6. TERMS OF DELIVERY

6.1 The delivery of the products ordered in the Webshop is possible by delivery service within Hungary or to abroad by priority, registered postal delivery by Magyar Posta Zrt.

6.2 In case of delivery the Supplier sends the product to the address given by the User. In case of delivery service within Hungary the date of delivery is included in the confirmation email which is sent to the User.

6.3 The Supplier sends the User the order in 3 days, after the purcase price arrived to the bank account.
In the case of domestic courier delivery, the delivery cost of the package is according to the weight limit.

If the product is sent to abroad with Magyar Posta Zrt. the price will be according to the valid GTC postal price.
In case of change of the prices of the Magyar Posta Zrt. the delivery prices can alter. The changes are published in every case in the GTC.

6.4 The Supplier is responsible for the deadline of the delivery date. After sending the product GLS or the Magyar Posta Zrt. will deliver it according to its own business regulations. The Supplier is not responsible for the duration of the delivery.

6.5 If the ordered product is not available the Supplier undertake the production of the product as soon as possible. The duration of the production takes on the average 14-30 workdays. In this case the User gets the product as postal delivery or personal takeover too.

6.6 If the Supplier cannot produce the product, it transfers back the prepaid price for the User in 15 days after coverage.

6.7 If the User finds damage in the product it is compulsory for the deliverer to take a protocol for the request of the User. The deliverer bears the responsibility for the damage.

6.8 If the User gives wrong delivery address in the order and the delivery is impossible the Supplier is not responsible for the default. In this case the Supplier notes the User in 5 days after the default to give the correct delivery address. If the User gives the correct address and asks for the repeated delivery it is only possible if the User –after the former transfer by PayPal or bank- transfers the delivery fee same time with the reply letter.

6.9 If the User does not reply for the warning of the Supplier in 5 days, or does not ask for a repeated delivery, or does not pay in time the price of the repeated delivery, the Supplier transfers back the paid purchase price for the User. In this case the Supplier does not have further obligation to the User.

 

7. THE RIGHT OF WITHDRAWAL

7.1 The User can withdraw from the buying of the ordered products in 14 workdays without justification. The 14 day deadline starts at the day of the arrival of the ordered products.

7.2 The User can put in practice his right of withdraval in a statement sent in e-mail. The withdrawal statement has to be sent to the email address fixed in this GTC in the 1st chapter related to the Supplier. In the withdrawal statement the User has to add all the datas included in the order, the code numer of the order, the date of the order and the date of reception of the product. Without these datas or in any other cases if the Supplier cannot identify which orderer/buyer/product the withdrawal is regarded to, or the statement is not sent within time limit the Supplier cannot accept the statement.

7.3 In case of a withdrawal the User is required to send the products for the Supplier in appropriate package (at least in similar package in which the User received the product) which guarantee that the products cannot be damaged. The costs of the return is paid by the User. In case of withdrawal the User is bound to send back the included bill to the Supplier.

7.4 After receiving the withdrawal statement the supplier reimburse the price paid by the User in 30 days. For the reimburse the product has to be undamagedly received by the Supplier before the 30 day deadline. The Supplier is entitled to substract the damage of the product if it was used inadequatly. The Supplier does not reimburse the delivery fee.

8. GUARANTEE AND EXPIRY DATE

8.1 The guidance for the responsibility of the Supplier for the guarantees and expiry dates are in the Civil Code and the 19/2014. (IV. 29.) NGM regulation.

8.2 The Supplier takes 6 months guarantee for all of the products. The Supplier only has to accoplish the guarantee claim if the product was damaged at the time of the puchase except if the User can proove the contrary. If the damage appears after 6 months the User is bound to proove that the product was damaged at the time of the purchase. The Supplier is only bound to accomplish the guarantee claim.

8.3 The summary of the warrantee and guarantee claim can be found on the website of the Hungarian Authority for Consumer Protection:

8.4 A guarantee claim can only be validated if the product was bought in the Webshop.

8.5 In case of a reparation of a defected product the User has to send the product and the copy of the purchase bill to the Supplier. If the User cannot present the bill, and it is not obvious that the product is manufactured by the Supplier the Supplier is not required to acomplish the guarantee claim.

8.6 Regarded to the information written above if the Supplier is not liable for a guaratee it notes the User, and sends the product back to the User. In this case the user pays the delivery fee. In other cases the costs of legitimite guarantee claim are paid by the Supplier (included the delivery fee).

9. COMPLAINT HANDLING

9.1 All the excuses and complaints about the activity or products of the supplier can be proposed on the accessibilities below:

9.2 For the handlig of the complaints the User has to transmit all datas of the order, included the confirmation code of the order. The Supplier needs these datas to identiy the affected accomplishment.

9.3 The Supplier examines the oral complaints, notes the complainer about her point of view and solve the complaint if it possible. If there is no possibility for solving the compaints because of the type of the complaint, or the User does not agree with the handling of the complaint, he has to send his complaint to the Supplier.

9.4 The Supplier examines and answers the complaints in 5 days. The answer is always justified.

9.5 If the Supplier and the User cannot resolve the consumer dispute through negotiations the User can use the law enforcements below:

9.6 The Supplier keeps the complaint correspondence for 3 years.

10. OTHERS

10.1 Modification of the product prices of the Webshop and the Website
The Supplier constantly update the content of the Website. The prices of the prodcts can be changed. The modified prices of the products come into force after the publication on he Website. The modified price is valid on the transactions after the modification.

10.2 Technical limits
If the User purchase ont he Website it is supposed that the User knows and accepts the possibilities and barriers of the internet special regard to technical performance and arising errors. If the Website does not work or the purchase is impossible because of internet network errors the Supplier is not responsible for the errors.

10.3 Standard legislations
For the questions which are not controlled in the present GTC and for the interpretation of the GTC the hungarian law is the standard particularly to the Act V. of 2013 law and law on electronical commercial services and service in related to the informational society Act CVIII. of 2001 law and law on contracts between consumer and enterprise 45/2014. (II. 26.) governmental regulation. The related legislations are standard for both sides without any clauses.
